Apologies for Absence and Substitution Notice

Minutes:

Apologies for absence were received from Councillors Mrs P A Channer CC and M F L Durham CC.  In accordance with notice duly given Councillor A S Fluker was attending as a substitute for Councillor Mrs Channer and Councillor Mrs M E Thompson as a substitute for Councillor Durham.

Disclosure of Interest

Minutes:

The Chairman advised that this item had been missed off the agenda and reminded Members of their need to disclose any Disclosable Pecuniary Interests, other Pecuniary Interests or Non-Pecuniary Interests having regard to paragraphs 6 – 8 of the Code of Conduct for Members.

 

There were no interests declared.

Exclusion of the Public and Press

To resolve that under Section 100A (4) of the Local Government Act 1972 the public be excluded from the meeting for the following item of business on the grounds that it involves the likely disclosure of exempt information as defined in Paragraph 1 of Part 1 of Schedule 12A to the Act, and that this satisfies the public interest test.

Application for a Grant of a New Hackney Carriage / Private Hire Dual Driver's Licence

To consider the report of the Director of Service Delivery, (copy enclosed).

Prior to consideration of this item of business the Chairman asked all parties present to introduce themselves.  The Chairman then sought confirmation that all present were in possession of and had read the report of the Director of Service Delivery along with Appendices 1 – 3.  A further copy of Appendix 3 was circulated at the meeting as it had been noticed that the copy originally circulated was incomplete.  The Chairman then outlined the procedure that would be followed.

 

The Licensing Officer took Members through the report highlighting matters before the Committee for consideration.

 

The Chairman then invited the applicant to make an opening statement.  The applicant introduced himself and provided the Committee with some further information in response to questions raised.

 

An Interested Party for the applicant, addressed the Committee providing details of work the applicant had carried out when working for his business.

 

The applicant then made a short closing statement.

Adjournment of the Meeting

Minutes:

RESOLVED that the meeting be adjourned at 10:06 to allow Members to consider the application.  It was noted that the Council’s Solicitor was requested to join Members during their discussion to provide further legal advice.

RESOLVED that the meeting resumed in closed session at 10:37.

Application for a Grant of a New Hackney Carriage / Private Hire Dual Driver's Licence - Decision

Minutes:

The Chairman advised that the Sub-Committee had considered the report of the Licensing Officer, the applicants’ personal circumstances and submissions and had regard to the Licensing Act and the Council’s Licensing Criminal Convictions Policy.  Referring to the Council’s Policy she informed those present that a licence would not usually be granted unless un exceptional circumstances.  The Sub-Committee felt that the applicant had not demonstrated any exceptional circumstances which would justify departing from policy.  It was considered that the applicant was not a fit a proper person to hold a Hackney Carriage / Private Hire Dual Licence. 

 

RESOLVED that the applicant be REFUSED a Hackney Carriage Private Hire Dual Licence.
